Federal Court

Action:

1. Appearance at trial or deposition - $40 witness fee + $0.585 per round trip mile
2. Appearance at trial or deposition in same city - $40 witness fee + no mileage
3. Documents only - no witness fee required

Above mileage fee is calculated as per IRS rules, effective 7/1/08.

A subpoena may be served at any place:
(A) within the district of the issuing court;
(B) outside that district but within 100 miles of the place specified for the deposition, hearing, trial, production, or inspection;
(C) within the state of the issuing court if a state statute of court rule allows service at that place of a subpoena issued by a state court of general jurisdiction, sitting in the place specified for the deposition, hearing, trial, production, or inspection; or
(D) that the court authorizes on motion and for good cause, if a federal statute so provides.

All subpoenas requesting medical records must be accompanied by an original signed Plaintiff's HIPAA Authorization.

New York State Court

Action:

1. Appearance at trial or deposition - $15 witness fee + $0.23 per round trip mile
2. Appearance at examination before trial - add $3 to witness fee
3. Appearance at trial or deposition in same city - $15 witness fee + no mileage
4. Documents only - $15 witness fee + $0.10 per page upon demand + no mileage

Only people living within New York State can be subpoenaed.

Subpoena for hospital medical records must be served 3 days prior to requested date. Subpoena for deposition or examination before trial for non-party witness must be served 20 days prior to appearance date.

Subpoena for records for City, State and Federal agencies must be so-ordered by judge.

All subpoenas requesting medical records must be accompanied by an original signed Plaintiff's HIPAA Authorization.
